Here is a brief overview of DUI laws in Louisiana.

 

 

The measure of the concentration of alcohol in your blood is conveyed as weight per unit of volume. This measurement is called your BAC, or your blood alcohol concentration.

In Louisiana, drivers who are found to have a BAC of 0.08% or above will be charged with a DWI.

Drivers who are under 21 years old and are found to have a BAC of at least 0.02% will be charged with DWI.

Unlike in other states, in Louisiana, refusing a chemical test comes with its own set of penalties.

When you accept a driver’s license issued by the Department of Public Safety and Corrections, you agree to submit to a chemical test when asked to do so by law enforcement.

This is referred to as Implied Consent. If you do not consent to a chemical test, you will face a drivers license suspension of 365 days for your first offense and 730 days for your second or subsequent offenses.
