If someone you care about has been arrested, it’s important to know what rights they have.
First Amendment Rights
All inmates are given First Amendment rights, which include things such as protecting them against cruel and unusual punishment.
The Right To Not Be Discriminated Against
Prisoners have the right not to be discriminated against, whether it’s regarding religion, race, age, gender, or anything else. If there is proven discrimination, the court can use rational-basis scrutiny to determine whether or not it is constitutional.
The Right Not To Be Harassed
Prisoners are given the right to not be harassed, neither by other inmates or prison staff. If an inmate reports that they are being harassed, it can lead to penalties for the perpetrators and criminal sanctions.
Rights For Disabled Inmates
If an inmate is disabled, they are granted the right to accommodations to suit needs, such as having enough space in their cell to turn and maneuver a wheelchair. Bathroom requirements must be met as well.
While there are certain rights that are afforded to inmates, the best thing you can do for a loved one who has been arrested is get them out of jail.
