All drivers should know what to do if they encounter a DUI checkpoint. Whether you’ve been drinking or not, all common sense can go out the window when you’re under pressure, so it’s important to plan ahead.
Here’s how to safely navigate a DUI checkpoint.
First and foremost, you are not required to go through a DUI checkpoint if you see one up ahead. If you’re able, you can make a legal U-turn or turn onto a side street. Just make sure you don’t break the law trying to avoid the checkpoint.
Cooperate throughout the duration of the checkpoint, but remember that police don’t have extra rights at a checkpoint. They cannot search your car or your trunk.
Remember, you have a constitutional right not to answer questions. If you say things like, “I only had one drink,” or, “I stopped drinking an hour ago,” those answers can be used against you later.
