Where an arrest warrant process is started by a police offer who files a statement with a judge explaining why they believe the person commited the crime, a bench warrant is issued by a judge.
Most commonly, bench warrants are issued when a defendant violates the rules of the court, such as not showing up when they are supposed to.
Though it may not sound as serious as an arrest warrant, a bench warrant gives police officers the authority to arrest the defendant and bring them before the court.
The purpose of bench warrants is to deter defendants from violating court orders, and to punish those who fail to appear as required by the court.
Bench warrants are very serious. If you are supposed to appear in court, it’s imperative that you show up when required so that you do not find yourself right back in jail.
